Trademark, Copyright Lawyers From IP Boutique Join McCarter & English As Partners in NYC Office

Timothy J. Kelly and Jessica Hiney, experienced intellectual property attorneys with a focus on trademark and copyright portfolio management and enforcement – both with significant domestic and international experience – have joined McCarter & English, where they will bolster the firm’s already-robust intellectual property practice.

Kelly and Hiney, colleagues earlier at the New York office of an intellectual property boutique, are both partners resident in McCarter’s midtown Manhattan office.

Both are active in all aspects of trademark and copyright law, including domestic and international portfolio management, trademark clearance, protection and enforcement, licensing and trade secret matters.

Kelly also represents clients in unfair competition and false advertising cases, and litigates in the district and appellate courts and before the Trademark Trial and Appeal Board. He also has negotiated and litigated Internet domain name and other e-commerce disputes. Kelly has represented clients in a wide range of industries, including clothing, human foods and confections, pet foods, pharmaceuticals, electronics, finance, appliances, and publications. He also has patent litigation experience in a range of technical areas.

Hiney’s professional background is similar, and she routinely advises clients on domestic and foreign trademark enforcement, opposition and cancellation issues, often assisting them with preparing and responding to cease-and-desist letters. She also counsels clients on trademark portfolio management and strategies in the apparel, shelving, charitable and financial services industries, among others.

“Our firm and our clients benefit greatly from having the experience, wisdom and excellence that Tim and Jessica bring us. Having both of them on our team is a coup,” said Elizabeth Hanley, the firm-wide leader of McCarter’s intellectual property practice. “They know the law, of course, but beyond that they bring to our clients a wealth of experience handling IP issues in a variety of industry sectors.”

Said Michael P. Kelly, chairman of the firm: “Adding Tim and Jessica to our firm and our New York office speaks to so many factors, all of which result in better results and service for our clients. Our IP practice is a national powerhouse, the brand-protection portion of it is second to none, and our New York office is benefitting from smart, measured growth.”

Before joining McCarter, Kelly and Hiney practiced together in the New York office of the intellectual property boutique Fitzpatrick, Cella, Harper & Scinto, where Kelly was a partner and chair of the Trademark Department and of the Consumer Goods practice group, and Hiney was counsel.
