(the “Company”).
Shearman & Sterling also advised Merrill Lynch, Pierce, Fenner & Smith Incorporated as dealer manager and solicitation agent in connection with the tender offer and consent solicitation by Arch Western Finance, LLC, the Company’s indirect subsidiary, with respect to its 6 ¾% Senior Notes due 2013.
