Trio of Leading Antitrust Partners Join Squire Sanders

Squire Sanders is pleased to announce the arrival of a team of leading antitrust partners to its Washington, DC office. The group is led by Mark Botti, who was previously the head of the antitrust and unfair competition practice at Akin Gump, and includes J. Brady Dugan and Anthony Swisher.

Mr. Botti represents clients on the full spectrum of antitrust matters, including government investigations, mergers and acquisitions, joint ventures, government and private litigation and competition policy matters. His work has spanned all sectors of the economy, including health care, pharmaceuticals and medical devices, biotechnology and agriculture, forestry products, intellectual property and insurance.

He also served for 13 years at the US Department of Justice (DOJ) in various litigation and leadership positions within the Antitrust Division. During this time he litigated and supervised complex antitrust matters, mergers and acquisitions, monopolization cases and joint ventures. He also served as the career Division official who directly oversaw the extensive hearings held by the Division and the Federal Trade Commission (FTC) on health care during 2004 and 2005.

Mr. Dugan focuses on criminal and civil antitrust, fraud and related matters. He served for over 15 years at the DOJ where he appeared in federal courts throughout the country on behalf of the Antitrust Division. Immediately prior to leaving the Division, Mr. Dugan worked in the National Criminal Enforcement Section, where he led investigations and prosecutions in a number of international cartel matters. While at the Division, Mr. Dugan investigated and prosecuted a wide variety of white collar federal crimes in addition to antitrust, including bribery, conspiracy, mail fraud, wire fraud and violations of the Foreign Corrupt Practices Act. He also has significant experience with the antitrust review of mergers and acquisitions in a variety of industries. Following the September 11 terrorist attacks, Mr. Dugan served over three years in the DOJ’s Office of Intelligence Policy and Review where he regularly appeared before the Foreign Intelligence Surveillance Court.

Mr. Swisher has extensive experience representing clients before the FTC and the Antitrust Division in connection with government antitrust investigations of mergers, acquisitions and joint ventures. He has represented clients in hundreds of matters and has deep experience in a wide range of industries, from insurance to health care to energy.

A frequent writer and speaker on antitrust topics, Mr. Swisher currently serves in the leadership of the Antitrust Section of the American Bar Association where he has held numerous positions, including Editorial Chair of the 2007 Annual Review of Antitrust Law Developments, the Antitrust Section’s flagship annual publication.  He also teaches antitrust policy at the University of Virginia.
