McDermott Bolsters Health Transactions, Regulatory Capabilities

International law firm McDermott Will & Emery LLP today announced the appointments of two leading healthcare lawyers, Dale Van Demark and Jason B. Caron, as partners in the Firm’s Washington, D.C. office. The two partners, who join from a leading health law firm, add further strength to McDermott’s top-ranked Health Industry Advisory Practice Group.

Mr. Van Demark is a health care transactional lawyer who focuses on health industry mergers and acquisitions (M&A) including hospital-hospital and hospital-physician deals. He has extensive experience in health system affiliation and restructuring transactions and regularly represents for-profit and tax-exempt clients in a variety of transactions. He also has a deep background in health care related tax exemption matters. Mr. Van Demark advises clients regarding the opportunities and challenges that have arisen in the wake of the Patient Protection and Affordable Care Act and the acceleration toward greater consolidation among providers. In addition, Mr. Van Demark advises clients on the issues that arise in the globalization of health care, including international patient programs and cross border affiliations. He speaks and writes regularly on matters related to his practice, most recently at conferences on the globalization of health care, in Venice, Italy, and Sao Paulo, Brazil. His articles have appeared in numerous journals such as BNA Health Law Reporter and AHLA’s Business Law & Governance.

Mr. Caron represents a variety of health care and life sciences organizations in legal, regulatory, reimbursement and policy matters — regularly providing strategic advice to clients. He has significant experience with navigating coding, coverage, payment, medical necessity, comparative research, certification, enrollment and payer participation issues, particularly in light of health reform. Mr. Caron spends considerable time planning, structuring and executing health care transactions and business arrangements. Additionally, he counsels clients in the areas of federal and state fraud issues, including anti-kickback, self-referral, false claims and false billings, and has experience guiding organizations through self-disclosures as well as government inquiries, audits and investigations. He also assists clients in evaluating, developing and implementing corporate compliance programs.

“We are dedicated to maintaining McDermott’s status as the top-ranked health care law firm in the nation and adding leading health lawyers is a key component of that strategy,” said Stephen W. Jason’s experience counseling top health, life sciences and medical device companies on many of the most pressing legal, regulatory and reimbursement issues further enhances our health and life sciences offerings to our clients.”
