Jones Day Expands Its Paris Banking & Finance Practice with Addition of Alban Caillemer du Ferrage and His Team

The global law firm Jones Day has announced that partner Alban Caillemer du Ferrage, of counsel Qian Hu, counsel Karole-Anne Sauvet, and associates Clément Saudo and Mathilde Nicand will join the Banking & Finance Practice in the Firm’s Paris Office on October 8, 2012.

Renowned as a leader in structured and derivative products and market infrastructures in France, Mr. Caillemer du Ferrage’s team, formerly at Gide Loyrette Nouel, will add to the Banking & Finance services offered in Paris by Frédéric Gros and his team, which focuses on financing, debt restructuring, and financial litigation. They will work closely with lawyers in London led by Edward Nalbantian, co-chair of the Firm’s Banking & Finance Practice, and the New York team led by Jayant Tambe, co-leader of the Firm’s Financial Institutions Litigation & Regulation Practice. Mr. Caillemer du Ferrage’s team will also collaborate with Jones Day’s mergers and acquisitions, litigation, public law, tax and antitrust teams to serve both financial institutions and corporate clients in all their financial transactions.

Mr. Caillemer du Ferrage’s team advises on all aspects of structured and derivative products, including regulatory, transactional (with a particular focus on strategic equity derivatives such as equity financings, competition/antitrust portage, share-buy back programs, equity release structures, macro and micro hedging), and litigation. It has developed a significant track record on issues related to the clearing mandate and new regulatory reforms applying to financial market infrastructures. Their practice is ranked in the top tier by Chambers Global, Chambers Europe, and The Legal 500 EMEA, and Mr. Caillemer du Ferrage is cited as a “leading individual” in the derivatives field.

Mr. Caillemer du Ferrage, 43, is the International Swaps and Derivatives Association (ISDA) counsel for France. He also acts as French counsel for several market makers associations that publish standard documentation for financial transactions, including The British Bankers’ Association, the Zentraler Kreditausschuff, the Treuhand Kammer of Switzerland, and associations sponsored by the Federal Reserve Bank of New York and the Federation of Bankers’ Association in Japan. He is a member of the “Markets and Exchanges” Consulting Commission of the French Monetary and Financial Authority (AMF), an Officer in the Banking Law Committee of the International Bar Association (IBA), a Professeur associe at the Law College of Assas (Paris II), and a member of The Hague P.R.I.M.E. Finance’s panel of arbitrators and international market experts. He is a frequent lecturer and author of articles about derivatives products and regulations and has been advising the French Tresor on several occasions on the drafting of financial bills and the implementation of EU financial directives. He is a member of the French delegation in charge of the negotiation of the UNIDROIT International Principles on netting.

Before joining Jones Day, Mr. Caillemer du Ferrage led the derivatives practice at Gide Loyrette Nouel, where he spent almost twenty years, ten of which as a partner in the Finance department. He started his career in the International Capital Markets department of Allen & Overy in London. Mr. Caillemer du Ferrage holds a postgraduate degree in Business and Private Law from the University of Pantheon-Sorbonne (Paris I). He is admitted to the Paris bar.

Qian Hu, 33, advises financial institutions and corporates on regulatory and transactional aspects of complex OTC derivatives deals and structured products. She is particularly active on equity derivatives transactions, including equity financing, strategic equity, portage, and share buy-back transactions. She has acquired significant experience in financial litigation and prelitigation management, notably in the context of Lehman Brothers’ insolvency. She holds a Master degree in Banking and Financial Law from Paris II Panthéon-Assas University, studied at Sciences Po Paris, and in the Foreign Affairs College of Beijing. She is a native Chinese speaker and is admitted to the Paris bar.

Karole-Anne Sauvet, 34, advises financial institutions and corporates as well as a number of professional associations (ISDA, ICMA, ZKA, EFET) on regulations of derivatives and financial collateral. She also works on structuring and negotiating derivatives transactions, repos, and securities lending transactions under standard market documentation. She has developed a focus on commodities, energy, and emissions allowances derivative transactions and is frequently involved in the hedging of securitizations, covered bonds, or project finance transactions. She has also recently acquired significant experience in relation to litigation on structured transactions concluded by territorial authorities. She holds a Master 2 in Banking and Finance Law as well as a Master in International Private Law from Paris II Panthéon-Assas University and studied at Sciences Po Paris. She is admitted to the Paris bar.

Clément Saudo, 32, advises clients on regulations, structuring, drafting, and collateralization of complex OTC derivatives transactions and temporary transfers of securities. He has worked on negotiation of master agreements (ISDA, EFET, FBF) for clients on commodities, emission allowances, shares, and interest rates as well as on regulatory and post market issues (clearing and registration with trade depositories). He holds a Master in Banking and Finance Law from Paris II Panthéon – Assas University, a DEA in Business Law from Paris Ouest Nanterre La Défense, as well as a Master Of International Law Studies (Magistère International d’Etudes Juridiques Appliquées) from Paris Ouest Nanterre La Défense following studies at New England School of Law in Boston (2003). He is admitted to the Paris bar.

Mathilde Nicand, 24, holds a Master 1 in Private Law of the University of Paris I Panthéon-Sorbonne (2010) (2008), a LL.B in English Law of the King’s College – University of London (2010), and a Master’s degree in Business Law from the University Paris II of Panthéon-Assas (2011). She is admitted to the Paris bar.
