Former FERC Division of Investigations Branch Chief Daniel A. Mullen Joins Fried Frank

Fried, Frank, Harris, Shriver & Jacobson LLP announced today that Daniel A. Mullen has joined the Firm as a partner in the Litigation Department and Energy Group, resident in the Washington, DC office. Mr. Mullen will head up the Firm’s Energy Enforcement Practice and provide counsel on energy and commodities enforcement matters as well as government investigations, enforcement proceedings and litigation.

Mr. Mullen joins the Firm having served most recently as a Division of Investigations Branch Chief within the Office of Enforcement at the Federal Energy Regulatory Commission (FERC). In this position, Mr. Mullen helped develop FERC’s existing enforcement regime and oversaw and conducted investigations and litigation against companies that participate in the wholesale electricity and natural gas markets. A frequent speaker on issues related to FERC’s enforcement program, Mr. Mullen focused on investigations concerning energy market manipulation, reliability and other violations of FERC-jurisdictional statutes, regulations and tariffs.

“We are delighted to welcome Dan to Fried Frank,” said Valerie Ford Jacob, Chair of Fried Frank. “We have a well-established enforcement and investigations practice and a growing profile in the energy space. Dan’s experience will further strengthen our capability in both areas.”

Through its team of former federal prosecutors and enforcement attorneys, Fried Frank has developed an international reputation for successfully handling the defense of corporations and individuals under criminal, civil fraud and regulatory investigation. The team conducts internal investigations, counsels clients and defends clients in enforcement actions and legal proceedings on matters involving allegations of securities, commodities, derivatives and other financial fraud; insider trading; stock manipulation; anticorruption violations; sanctions violations; money laundering; RICO violations; and procurement and healthcare fraud.

“Fried Frank has a strong enforcement and investigations practice that is well-regarded,” said William G. McGuinness, Chair of Fried Frank’s Litigation Department. “The depth of Dan’s experience with investigations, enforcement proceedings and litigation will be invaluable to our clients that participate in the energy and commodities space.”

Fried Frank’s energy lawyers have extensive experience advising clients on transactional, regulatory and compliance, and litigation matters in the physical and financial energy industry. The multidisciplinary team counsels the full spectrum of players in the conventional and renewable energy sectors and the wholesale and retail energy markets.

“Enforcement matters in the commodities, derivatives and energy spaces continue to grow in importance,” said Michael A. Yuffee, partner in Fried Frank’s Energy Practice. “Dan’s unique role in helping to create FERC’s current enforcement program will benefit our clients enormously.”

Before joining FERC, Mr. Mullen was a partner at McDermott, Will & Emery. He has broad-based trial and appellate experience in complex commercial matters in state and federal courts, as well as in defending publicly traded and privately held clients in investigations by the US Commodity Futures Trading Commission.

Mr. Mullen received his JD from Cardozo School of Law and his BA from Tufts University. Mr. Mullen is a former law clerk for Judges Ross and Bartels of the Eastern District of New York. He is admitted to the bar in Washington, DC, New York and New Jersey.
