Faegre Drinker Adds Veteran Department of Justice Trial Attorney Dylan Carson to Growing Antitrust Practice

Faegre Drinker announced today that Dylan Carson has joined the firm’s Denver and Washington, D.C. offices as partner in the antitrust practice of the firm’s litigation group. Carson was previously a trial attorney for the U.S. Department of Justice (DOJ) in the Media, Entertainment, and Communications section of the Antitrust Division, and a leader of three of DOJ’s most recent merger trials in federal court.

“Dylan brings exceptional litigation experience and a unique perspective built from an over 20-plus year career representing clients in federal and state court antitrust trials, as both plaintiff and defendant,” said Faegre Drinker litigation team co-leader Dan Collins. “His addition strengthens our national antitrust litigation practice, which continues to expand and service major companies in complex antitrust matters and class actions. We are thrilled that Dylan chose Faegre Drinker after a distinguished career in public service.”

A trial attorney with significant experience in antitrust litigation, federal and state government antitrust investigations, and competition law counseling, Carson is among the short list of antitrust attorneys to have successfully prosecuted and defended high-stakes merger trials. He has also represented clients before federal and state antitrust enforcers, including the DOJ, Federal Trade Commission and state attorneys general.

Carson explained, “It has been a privilege to enforce the antitrust laws on behalf of American consumers and to work with all the stellar DOJ lawyers and economists at the Antitrust Division. Now I am excited to join the growing and talented antitrust group at Faegre Drinker and contribute to the firm’s storied history of providing outstanding client service in the areas of antitrust law and business litigation. The firm’s client-centric approach, strong culture of collaboration and deep bench of courtroom-tested trial attorneys make for an excellent fit with this next chapter in my career.”

Carson offers clients his knowledge of public and private antitrust enforcement in Washington, D.C., and around the country to navigate the complexities of civil and criminal investigations and litigation. He has advised clients about shepherding mergers and acquisitions through the approval process, handling federal and state government antitrust investigations, and crafting compliance programs to avoid the risk of antitrust enforcement and treble damages actions. He has represented parties involved in merger and civil nonmerger investigations in diverse industries, including telecommunications, cable and satellite television, e-commerce, online platforms, energy generation, finance, casinos, and food and soft drinks. Notably, Carson repeatedly has been involved in large, complex telecommunications and technology litigations, including monopolization cases and price-fixing prosecutions.

In high-profile matters at DOJ, Carson gained significant exposure to the health care industry and many of its key market participants. In private practice, he has represented large, multinational manufacturers of branded and generic pharmaceuticals and medical devices, and been involved in large-scale multidistrict litigation, including the trial of bellwether cases.

For his efforts at DOJ, Carson received the Attorney General’s Award for Distinguished Service, the second highest award for employee performance at the Department of Justice. For three years straight, he received the Assistant Attorney General Award of Distinction, the highest Antitrust Division performance award, based on his investigation and litigation work.

Before DOJ, Carson was a partner at a national trial firm in Denver. After graduating law school, Carson served as a law clerk in the District of Massachusetts for the Hon. Frank Freedman. He earned his Juris Doctor from Suffolk University Law School, where he graduated cum laude and served as lead articles editor for Suffolk University Law Review. Carson received his bachelor’s degree from Vassar College.

Carson is the third partner to join Faegre Drinker this week, following Tuesday’s addition of Lenny Asaro, a member of the real estate and construction practice, and Alison Baldwin, who joined the firm’s intellectual property practice, both in Chicago. Faegre Drinker has added five partners in the first five weeks of 2021 including antitrust attorney Alicia Batts in Washington, D.C.

With 250 litigators licensed in key jurisdictions throughout the United States, China and the U.K., Faegre Drinker’s litigation team provides unparalleled counsel services, comprehensive on-the-ground litigation support and key local court relationships.
