Arnold & Porter LLP announced today that eight Intellectual Property litigators have joined the firm and will be resident in its Silicon Valley office. The addition will expand the firm’s IP litigation capability across a wide range of industries. It also adds a top tier Section 337 patent litigation practice with extensive experience before the U.S. International Trade Commission.

The new lateral partners joining Arnold & Porter include:
James C. Otteson, the former head of a West Coast-based firm’s national ITC Litigation Practice, where he practiced for 18 years. He has a total of 24 years of experience in intellectual property litigation, including patent, copyright, trade secret and trademark cases in both the state and federal trial and appellate courts. Notably, he has successfully briefed and argued multiple appeals in the U.S. Court of Appeals for the Federal Circuit, and has successfully tried multiple ITC cases for both respondents and complainants. Otteson obtained his undergraduate degree in microbiology from Brigham Young University and his JD from Yale Law School. He also served as a judicial clerk to the Hon. Byron J. Johnson of the Idaho Supreme Court.
David A. Caine, who has also represented many U.S. and foreign clients in the federal and state courts, the ITC, and before arbitrators and mediators, in matters spanning a wide range of technologies. Caine graduated from the University of Virginia, with distinction, with a BA in Chemistry and Spanish; he obtained his JD from the University of Virginia School of Law, Order of the Coif.
Thomas T. Carmack, whose practice focuses on patent, trade secret and complex commercial litigation in state and federal court, as well as in the ITC, representing domestic and foreign technology companies. Carmack graduated from Brigham Young University with a BS in molecular biology and obtained his JD from the University of California, Davis.
Philip W. Marsh, who has represented clients in numerous technology-related patent cases. He has also litigated trade secret, copyright and trademark issues. Marsh graduated from the University of Utah, with honors, with a BS in electrical engineering, and obtained his JD from The George Washington University Law School. He also worked as an examiner in the U.S. Patent and Trademark Office.
