McDermott Brings on High Profile White-Collar Partner Andrew E. Tomback in New York

International law firm McDermott Will & Emery today announced that prominent trial attorney Andrew E. Tomback has joined the Firm as a partner in its White-Collar & Securities Defense Practice Group, based in New York.

Mr. Tomback is a highly accomplished and nationally recognized trial attorney with 25 years of experience drawn from government service, business, ‎and private practice. He represents clients in a full range of civil ‎and criminal litigation before the courts, U.S. Securities and Exchange ‎Commission (SEC), and various other regulators in matters ‎involving federal securities laws, complex litigation, and international ‎arbitrations. His white-collar practice has included the defense of ‎individuals facing charges of insider trading, stock manipulation, bank ‎and insurance fraud, violations of the Foreign Corrupt Practices Act ‎‎(FCPA), inadequate disclosure in derivative transactions, and Ponzi ‎schemes, as well as market timing and late trading. He has represented ‎individuals and institutions in grand jury, SEC, and internal corporate ‎investigations.

McDermott continues to advance the strategic growth of its global white-collar and securities defense team with the addition of distinguished attorneys widely regarded for their success in both the public and private sectors. In the last two years, high profile additions have included former federal prosecutors Todd Harrison in the New York office, Michael Wynne in the Houston office, A. Marisa Chun in the Silicon Valley office, and former U.S. Attorney Marcos D. Jiménez, based in the Firm’s Miami office.

Mr. Tomback comes to McDermott after serving as General Counsel at Scientific Games Corporation. He was previously a partner at prominent New York law firms where he defended corporate clients and individuals in both civil and white-collar criminal and regulatory investigations.

Reflecting his deep commitment to public service, Mr. Tomback has also had a distinguished career in the public sector. He served as Deputy General Counsel at the Resolution Trust Company (RTC), created by the federal government in the wake of the savings and loan crisis in the 1980s. At the RTC, Mr. Tomback managed more than 500 attorneys and investigators handling federal savings and loan resolutions and represented the agency and its CEO in the Whitewater grand jury investigation.

Mr. Tomback’s wide-ranging public service experience also includes service as the Senior Advisor to the Undersecretary of Enforcement at the U.S. Department of the Treasury where he advised the undersecretary on all enforcement including Customs, Secret Service, ATF, FinCEN, and directed the Office of Policy and Evaluation. He investigated the Waco tragedy, played an integral role in the passage of the Brady Bill, the Assault Weapons Ban, and the 100,000 Cops Crime Bill. He also represented the Treasury on all interagency law enforcement issues.

Mr. Tomback served as a law clerk to the Honorable Stanley Sporkin of the U.S. District Court for the District of Columbia. Mr. Tomback then became an Assistant U.S. Attorney in the Southern District of New York where he conducted grand jury investigations and prosecuted criminal cases, concentrating on complex securities frauds including stock manipulations, insider trading, international tax evasion enterprises, and penny stock schemes.

Mr. Tomback graduated from Yale College, Summa Cum Laude and Phi Beta Kappa, and earned his J.D. from Yale Law School where he was an editor of the Yale Law Review.
